Terms of Service

These Terms of Service (“Terms”) govern your use of Taptic Data, LLC(“Taptic Data,” “we,” “us,” or “our”) products and services (the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1) Account & Eligibility

You must be at least 18 years old to use the Service. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account. Companies may invite additional users under their subscription plan and are responsible for their users’ compliance.

2) Subscription & Billing

Paid plans are billed through Stripe on a recurring basis (monthly or annually, as selected). Fees are non-refundable except where required by law. Subscriptions renew automatically unless cancelled prior to the next billing date. You can manage or cancel at any time via the Billing Portal.

• Upgrades and downgrades take effect as described at checkout or in the Billing Portal.
• Applicable taxes may be added to your charges where required.
• Failure to pay may result in suspension or termination of access.

3) Acceptable Use

You agree not to misuse the Service. Prohibited activities include unlawful conduct, attempting to gain unauthorized access, interfering with operations, distributing malware, scraping at abusive rates, or ingesting infringing or harmful content. We may suspend or terminate accounts that violate these rules. See also our Acceptable Use Policy.

4) Data Ownership & Processing

You retain all rights to the data you upload or connect to Taptic Data. You grant us a limited license to process and store that data solely to provide and improve the Service. Our handling of data is governed by the Privacy Policy and the Data Processing Addendum.

5) Service Availability

We strive for high availability and resilience. Planned maintenance or third-party outages may temporarily affect availability. For uptime targets and support standards, see our Service Level Agreement.

6) Intellectual Property

The Service, including software, designs, and documentation, is owned by Taptic Data or its licensors and protected by law. These Terms do not transfer ownership of our intellectual property.

7) Termination

You may stop using the Service at any time. We may suspend or terminate access for violations of these Terms, for non-payment, or as required by law. Upon termination, your access will cease and data associated with your account will be handled according to our retention policy.

8) Disclaimers

The Service is provided “as is” and “as available.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free.

9) Limitation of Liability

To the maximum extent permitted by law, Taptic Data’s total liability for any claim arising out of or relating to the Service will not exceed the amount you paid to Taptic Data in the twelve (12) months preceding the claim.

10) Indemnification

You agree to defend, indemnify, and hold harmless Taptic Data from and against claims, damages, liabilities, and expenses arising from your use of the Service or violation of these Terms.

11) Governing Law & Venue

These Terms are governed by the laws of the State of Illinois, USA, without regard to conflict-of-law principles. The exclusive venue for disputes shall be the state or federal courts located in Illinois.

12) Changes to These Terms

We may revise these Terms from time to time. Updates will be posted here with a new “Effective Date.” Continued use of the Service after updates constitutes acceptance of the revised Terms.
